Josh Seltzer began his career as house counsel for national property and casualty insurers AmTrust Financial, Inc. and Tower Group Companies, and represented them and their member companies in all types of insurance and non-insurance matters. Josh has more than 20 years experience representing insurance clients in key industries including transportation, building, real estate, and construction, and provides comprehensive coverage counseling involving all types of manuscripted and standard-form risk, including garagekeepers, vendor/vendee, commercial auto, CGL, builder’s risk and wrap-up, property and businessowners. Josh frequently counsels clients on tender and risk transfer issues, including where next-in-line coverage hinges on moving-part decisions involving the interplay between additional-insured coverage and contractual liability coverage under the “insured contract” exception.

Josh has been lead counsel in multi-million dollar first-party business interruption, and extra-contractual damage claims involving quota share policies in state and federal courts and FAA-governed arbitrations throughout the country seeking damages for bad faith breach of contract, and routinely navigates coverage issues involving apportionment, expected or intended harm, known loss, reasonableness of mitigation, fraud, and non-fortuity and pre-existing injury or damage defenses. Josh has briefed and argued many reported decisions involving additional-insured coverage under ISO and manuscript endorsements, duty-to-defend and trigger, priority-of-coverage, mid-term cancellations under N.Y. Ins. Law § 3426(e), continuous injury and allocation, and common law and statutory waiver and estoppel.
